Exclusions of Liability Insurance Products

In the article above , I discussed the concept of product liability. Today, I write about the exclusions.

Excluded from all damages arising from:

- Acts and / or intentional omissions

- Caused the damage provided that such employees are outside the Workers’ Compensation Insurance

- Caused to people who are guaranteed by this insurance and people who live with them

- Caused to shareholders, directors, managers for the insurance contract in which they are framed

- Caused by the subsidiaries above entities

- Derived from accidents caused by acts of war, rebellion and civil disorder

- Extrajudicial costs to investigate cause of accident unless the insurer authorizes

- Products containing asbestos or silica

The exclusions listed below may be included in the policy by negotiation with the insurer:

- Caused to property of others entrusted to the insured

- The cost of recalls of defective products

- Cost of replacement or repair of defective products

- Damage caused by the change of the environment

- Damage caused by products intended to prevent or encourage pregnancy

- Caused by the action of fields electromagnécticos

- Damage to third party products manufactured by the transformation of the unauthorized insurance products

- Damage caused by third-party products that incorporate the product of the insured and at all times be possible to separate the products

- Spending on product repackaging
